1About these terms

babaluxurycar.com is run by Baba Luxury Car (“Baba Luxury Cars”, “we”, “us”), B-2, Emaya Mall, Paschim Vihar, New Delhi 110063. By using the site you agree to these terms. If you do not agree, please do not use it.

These terms cover the website. When you buy, sell or exchange a car with us, the written agreement and invoice for that sale also apply, and where they differ from these terms, they prevail.

2Cars, prices and photographs

• Every car on the site is pre-owned. We describe each one as accurately as we can, but the details (specification, kilometres, ownership, service and insurance history, features) are given in good faith and may contain errors. Please confirm anything that matters to you with us, and see the car, before you decide.
• Cars are shown subject to availability. A car may be sold, booked or withdrawn before the site is updated.
• Prices are in Indian rupees and may change without notice until a sale is agreed in writing. Unless we say otherwise, they do not include registration transfer, insurance, finance or other charges; we set these out before any sale.
• Photographs are of the car itself where we have them, but colours and condition can look different on screen. Some cars on the site are shown as showcase models, marked as such, to illustrate what we deal in.
• An inspection report or condition note describes the car as we found it on the day it was inspected. It is not a warranty.

3Enquiries and calls

Sending an enquiry, booking a one-to-one call or sending a concierge brief does not create a contract and puts you under no obligation. We will try to reply quickly, usually by phone or WhatsApp during our hours (11 am to 8 pm IST, every day), but cannot promise a time.

Please give accurate details and only your own contact details, or details you are allowed to share.

4Buying a car

• A purchase is agreed only when we confirm it in writing and the agreed booking amount or price is paid. What your advance (booking amount) reserves, and what is refunded if you cancel, is set out in our Booking and cancellation policy.
• We encourage you to inspect the car and take a test drive (see our Test drive policy), and you are welcome to bring a mechanic of your choice.
• Ownership passes when the full price is paid. We transfer the registration through the RTO ourselves, under the Motor Vehicles Act, 1988 (Forms 29 and 30), with the documents the transfer needs from you; see our RC transfer policy.
• Any warranty is only what the manufacturer’s remaining warranty or our written agreement provides.
• Delivery is charged on top of the price of the car, as agreed with you; see our Delivery policy.

5Selling or exchanging your car

• Any figure we give before we have seen your car is an estimate, not an offer. Our offer is made after we inspect the car and its papers, and it is binding only when we agree it in writing.
• You confirm that you are the registered owner of the car, or are authorised to sell it, and that the documents you give us are genuine.
• Please tell us about any loan on the car, accident damage, repairs, insurance claims or pending challans. A financed car can be sold once the loan is closed and the lender’s NOC (and Form 35) is issued.
• Payment is made as agreed in writing, once the documents needed for the transfer are handed over.
• In an exchange, your car’s agreed value goes towards the car you buy from us.

6Concierge and work on cars

When we find a car for you, or arrange work on one (such as coating, film, wraps, upgrades or a fancy number), we will quote you before anything is done, and nothing is done without your approval. Work by specialist partners carries their own warranty and terms, which we pass on to you.

7Using the site

You may use the site for your own, lawful purposes. You must not:

• send false or misleading enquiries, or enquiries in someone else’s name;
• copy, scrape or republish our listings, photographs or text in bulk, by hand or by automated means;
• try to break into, overload or interfere with the site, its database or its admin area;
• use the site to send anything unlawful, harmful or that infringes anyone’s rights.

We may change, suspend or withdraw any part of the site at any time.

8Our content and trade marks

The site’s design, text, photographs, videos and the Baba Luxury Car name and logo belong to us or to those who license them to us. You may share links to our pages, but you may not reuse our content without our written permission.

The names and logos of car makers shown on the site belong to their owners and are used only to identify the cars we buy, sell and source. We are an independent dealer, not an authorised dealer of, or affiliated with, any manufacturer, unless we say so.

9Other sites

Links to WhatsApp, Instagram, YouTube, Google Maps, Apple Maps and other sites are there for your convenience. We are not responsible for their content or how they handle your data.

10Our responsibility

We take care to keep the site accurate and available, but it is provided “as is”, and we cannot promise it will always be error-free or uninterrupted. To the extent the law allows, we are not liable for any loss caused by relying on information on the site without confirming it with us, or by the site being unavailable.

Nothing in these terms limits your rights as a consumer under the Consumer Protection Act, 2019, or any liability that cannot be limited by law.

11Your privacy

How we collect and use your personal data is explained in our Privacy policy.

12Law and disputes

These terms are governed by the laws of India. If you have a complaint, please tell us first and we will try to resolve it. Any dispute that cannot be resolved between us is subject to the exclusive jurisdiction of the courts at New Delhi, without affecting your right to approach a consumer commission under the Consumer Protection Act, 2019.

13Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed; the version on the site when you use it is the one that applies.
